BIDDER DECLARATION

BY PARTICIPATING IN ANY OF OUR AUCTIONS I (the client) UNDERSTAND AND ACCEPT THE TERMS AND CONDITIONS AS PRESENTED BELOW, ESPECIALLY THE KEY TERMS THAT ALL ITEMS ARE SOLD AS-IS, WHERE-IS, WITH NO GUARANTEES OR WARRANTIES. I AM SOLELY RESPONSIBLE FOR DETERMINING THE IDENTIFICATION, CONDITION, AND/OR USE OF ALL ITEMS PURCHASED. REFUNDS WILL NOT BE ISSUED DUE TO ANY DESCRIPTIVE ERROR PROVIDED BY THE AUCTIONEER OR SIERRA AUCTION, OR DUE TO MY FAILURE TO PROPERLY IDENTIFY THE ITEM, ITS CONDITION, ITS QUANTITY OR USABILITY. I ACKNOWLEDGE THAT SIERRA IS NOT LIABLE FOR ANY INJURY OR LOSS TO MY GUESTS OR MYSELF.

We may require a $100.00-$500.00 deposit hold in order to participate in our auctions. This registration deposit hold is part of the purchase and will be applied toward the invoice total. If you do not win any lots, the hold will be released. This can take up to 30 days depending on YOUR bank to release.

Per city code, if you are a City of Phoenix or a City of Tempe employee, you are not permitted to bid on any respective City of Phoenix or City of City of Tempe assets, either knowingly or unknowingly. By participating in our auction, you are agreeing & abiding to this restriction.


WINNING BIDDERS – PLEASE READ!

If you are the winning bidder of an item in a vehicle or commercial equipment auction, a $250.00 non-refundable deposit for each winning bid is REQUIRED and WILL BE proactively charged to your credit card on file as well as applied to your invoice. By registering for our auction, you are providing authorization for Sierra to complete this deposit transaction. If the card is declined, your bidding account will be placed on temporary hold, and you will be contacted to arrange payment of this deposit. To ensure a seamless bidding experience, please be sure to have a credit/debit card on file.

All payments must be received by Sierra Auction, and lots must be picked up no later than 3:00 PM on the due date specified in the auction’s Terms and Conditions and the invoice email instructions. Sierra Auction reserves the right to charge late payment fees and storage fees if this deadline is not met.

If buyer fails to fulfill their obligation of any of these terms and conditions in their entirety, your non-refundable deposit of $250.00 AND any additional amounts (if applicable) that add up to 14.00% of your high bid will be kept as a renege fee. The additional amount will be charged to the same credit card to complete the entire penalty for breaching the purchase contract. In addition, your bidding status with Sierra Auction may be revoked depending on the circumstances of the transaction.


SALES TAX EXEMPTION QUALIFICATIONS

Sales Tax will be charged on all purchases, unless Sierra has on file or receives prior to the auction (1) Sales Tax Exemption Certificate acceptable to Sierra and to the State of Arizona, (2) COMPLETED Arizona Form 5000A, and (3) a separate automobile dealer exemption certificate/license if you purchased a titled asset. (4) Letter of Authorization, if you are not the company owner. You will not be granted tax exemption post-sale if these forms are not completed to the satisfaction of Sierra. Customers and/or Buyers will ONLY be tax exempt for those assets which are listed on the Form 5000A. Non-dealer out-of-state buyers who intend to register the vehicle outside of Arizona will be required to fill out an AZ form 5010 or 5011 depending on their circumstances and, if acceptable, state sales tax may be waived partially or in full. The buyer in this scenario is still required to pay the city and county taxes where applicable.

Please make sure you have a PAID invoice on your mobile device or printed out before coming to pick up assets. You will receive a PAID invoice via email once your payment has been received, cleared, and processed. Please note that some bank transfers/wires may take up to 24 hours to be received. The quickest way for payment to be cleared is via Direct Deposit, or by Credit/Debit Card. Submitting a picture of your direct deposit receipt to cashiers@sierraauction.com email may allow for near-same-day application to invoice/debt.

Credits on Account:

Sierra provides refunds to buyers in the form of a credit when the amount is up to $50.00. The credit(s) will display in your Sierra Auction Account and can be used as payment for any future auction events within 365 days of it being issued. If credits are NOT used during that time, the amount is forfeited and removed from your account balance.

Sales Tax will be charged on all purchases, unless Sierra has been provided with a valid and legal Resale Tax License and completed Arizona Form 5000A Tax Exempt Certificate, PRIOR to the auction sale date. NO EXCEPTIONS!

Sierra retains all its legal rights, including, but not limited to, suing Buyer to compel specific performance, and/or declaring the Buyer in breach of contract, and retaining the deposit and barring the Buyer and Buyer’s agents from all future auctions. Sierra, at its sole discretion, may offer unpaid goods for sale in a private sale or any future Sierra auction. Buyer shall be responsible for any deficiency, including late payment fees and storage fees. Buyer shall have NO right to ANY excess funds such sale/auction may generate. Sierra reserves the right to change the fee structure, refuse to accept certain credit cards, and/or require cash payments in its sole discretion and without notice.

THIS INCLUDES PHYSICAL PREVIEW, STARTING AND OBSERVING VEHICLES, HISTORY REPORTS, AND MARKET REPORTS. SIERRA *GENERALLY* OFFERS PUBLIC IN-PERSON PREVIEW THE FRIDAY BEFORE EACH AUCTION EVENT. NO PUBLIC PREVIEW FOR NONRUNNING VEHICLE AUCTIONS. IT IS THE BUYER’S RESPONSIBILITY TO PLACE INFORMED BIDS BASED ON THEIR DUE-DILIGENCE. IF YOU ARE UNSURE OF THE UNIT’S CONDITION, PLEASE DO NOT BID!

DUE TO ADVANCES IN COMPUTER DIAGNOSTIC TECHNOLOGY AND FOR THE PROTECTION OF CONSIGNOR ASSETS, SIERRA AUCTION WILL NO LONGER BE ALLOWING OUTSIDE OBD 2 DIAGNOSTIC SCANNERS ONSITE. THIS INCLUDES HANDHELD SCANNERS, POCKET SCANNERS, BLUETOOTH SCANNERS, AND LAPTOP COMPUTERS. WE DO UNDERSTAND THIS IS AN INCONVENIENCE SO WE HAVE OBD 2 DIAGNOSTIC COMPUTERS AVAILABLE TO CHECK-OUT FOR FREE. A PHOTO ID IS REQUIRED TO CHECK THE SCANNERS OUT AND MUST BE RETURNED IN A REASONABLE AMOUNT OF TIME. YOUR COOPERATION IS GREATLY APPRECIATED.


DEFINITION OF TYPES OF AUCTIONS

Passenger Vehicles - Vehicles that are traditionally driven through an auction lane for buyers to see. Due to restrictions and new online-only auctions, these vehicles are not driven through a lane open to the public. These vehicles are driven at slow speeds onsite while processed in and buyers can have a level of confidence that the vehicle can move forward/backward. Under NO circumstances does Sierra warrant that these vehicles are free from defects in the engine, transmission, electrical, or drivetrain. Drive status is not guaranteed.

Nonrunning / Stationary - Vehicles auctioned with or without a key and may either be unable to start or deemed unsafe to drive or undriveable. Vehicles in this category could include engine problems, missing parts, collision vehicles, or virtually any other issue that could cause a vehicle to be a non-runner. Keys are NOT guaranteed for inoperable vehicles.

Fleet and Heavy Equipment – These vehicles and other assets are in various running and driving condition. Units may have missing parts and are non-running or may have been fleet maintained and in good working order. It is highly recommended that these units be inspected prior to bidding to ensure confidence in placing bids. Keys are NOT guaranteed for inoperable units. .

Toys (Boats, RVs, Motorcycles, and Carts) – These vehicles and other assets are in various running and driving condition. Units may have missing parts and are non-running or may have been fleet maintained and in good working order. It is highly recommended that these units be inspected prior to bidding to ensure confidence placing bids. Keys are NOT guaranteed for inoperable units.

ALL Vehicles Are Sold Strictly AS-IS WHERE-IS, without WARRANTIES OR GUARANTEES OF ANY KIND. Sierra is a state-licensed Public Consignment Auction Dealer and is exempt from providing warranties of any kind or selling vehicles with a passing emissions statement. Keys are NOT guaranteed for inoperable units.


TITLE INFORMATION

Arizona specifically identifies odometer mileage and brand of the cars on the title as one of each of the following categories:

Odometer:

  • BOX A – Actual Mileage.
  • BOX B – Mileage exceeds the mechanical limits of the odometer.
  • BOX C – True Mileage Unknown.
  • EXEMPT – Mileage isn't required during transfer.

TITLE DELAY: Title is in process with the consignor or MVD. It may take up to 30 days to arrive.

Brand:

Left blank – CLEAN TITLE. No brand, which means the State of Arizona has not recognized an incident to this vehicle that would brand it a salvage vehicle. This in NO WAY means that the state has not erred in recognizing a vehicle’s previous salvage brand in another state. Please do your DUE-DILIGENCE in researching the title status of a vehicle prior to bidding.

Restored Salvage – Vehicle was previously salvaged and has been brought up to a road-worthy status per state regulations and requirements.

Salvage – Vehicle has had one or more incidents (such as a total loss from theft/recovery, flood/water damage, fire, severe accident) such that its condition requires the state to brand the vehicle as not road-worthy.

Please be aware that titles are MAILED to the ADDRESS ON FILE, which is reflected on your invoice. To avoid a re-mailing fee, PLEASE double-check the accuracy of your mailing address that you entered in your account. Any buyer whose title comes back undeliverable WILL be assessed a returned title fee of $25.00 if paid via direct deposit. The returned title fee is $25.75 if paid with a credit/debit card.

Please review any and all additional terms and conditions written in the invoice email you receive upon a successful vehicle purchase.


AUCTION DAY INFORMATION

Reserve Not Met - This means that the item has a reserve price amount that must be met before the item can be sold. If the item does not meet the reserve amount requirement the last bid may be offered to the seller and the vehicle could be then sold through the offer/acceptance process in which both parties agree to the final bid price.


ERRORS IN BIDDING

If you make a bid error, you must contact Sierra before the start of “auction closing” to have your bid removed at 602-242-7121 and/or cashiers@sierraauction.com. NO REFUNDS FOR BIDS MADE IN ERROR WHILE THE AUCTION IS ONGOING/CLOSING OR AFTERWARD. Operator error, keystroke mistakes (“fat-fingered,” accidental touch), misunderstanding of auction structure, and other errors are the bidder's sole responsibility. Remember, those who use YOUR ACCOUNT to place bids are ultimately YOUR RESPONSIBILITY - authorized or unauthorized use of your account to bid is STILL YOUR RESPONSIBILITY.


GENERAL TERMS

Sierra Auction Management, Inc. (-“Sierra”-) is acting as an auctioneer-agent for many cities, counties, the State of Arizona, many large and small companies, and people like yourself that are seeking to sell items they no longer need. Sierra may act as a Main Principal, Buyer, or Seller in the sale of any item. Sierra is not responsible for the actions of its consignors and/or singular principals.

A Valid ID is required to register, pay, and pickup at all Sierra Auction locations and hosting properties.


AUCTION TERMINOLOGY

It is the responsibility of the bidder to understand the manner in which items are being auctioned. THE BIDDER MUST UNDERSTAND WHAT THEY ARE BIDDING ON AND HOW IT IS BEING SOLD; IF NOT, ASK FOR CLARIFICATION OR DO NOT BID!

ADDITION TO OR WITHDRAWAL FROM SALE - The auctioneer/Sierra reserves the right to withdraw from the sale any property listed and also to add property not listed to the sale. Also, the auctioneer/Sierra may group lots or subdivide lots in order to benefit the seller.

INTERRUPTION OF SERVICE: Sierra Auction Management, Inc, shall not be held responsible for any interruption in service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted, or error-free service or use of its website. Technology can and does fail. The bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. Sierra Auction Management, Inc., in its sole discretion, may void any sale, temporarily suspend bidding and re-list any items or lots that in Sierra Auction Management, Inc.’s discretion was affected by any malfunction.

DURING THE AUCTION, BIDDERS ARE REQUIRED TO BE ON THE MAIN PAGE OF THE AUCTION WEBSITE TO PLACE THEIR BIDS (THE AUCTION BLOCK). Please be advised that if you are viewing a vehicle lot description page, the auction timer displayed may not refresh in time. Consequently, any bids placed from these pages may not be successfully registered.

ALL SALES ARE FINAL. ALL ITEMS ARE SOLD 'AS-IS WHERE-IS,' WITH ALL FAULTS AND WITHOUT WARRANTIES. Catalog, web, and advertising descriptions are NOT guaranteed. Sierra is NOT liable for any errors, omissions, or inaccuracies in the catalog or other written or verbal descriptions even if caused by Sierra’s gross negligence. Bidders are responsible for thorough inspection of items before bidding and to satisfy themselves of such matters as to suitability, marketability, completeness, year, make, model, and/or condition. IF YOU ARE UNSURE AS TO ANY MATTER, SIERRA URGES YOU NOT TO BID. YOU MAY NOT SOLELY RELY ON SIERRA’S DESCRIPTIONS OR INFORMATION, WRITTEN OR VERBAL. The auctioneer/Sierra reserves the right to reject any and all bids. Since Sierra Auction discloses ALL fees upfront, it is YOUR responsibility to bid up to a number with which you are comfortable. YOU control how much you are willing to pay for an item. “Title/Ownership” and “Risk of Loss or Damage” transfers to Bidder as soon as each individual lot is sold, subject only to Sierra’s right to reconcile the auction. Errors by auctioneer/Sierra shall make the sale voidable at auctioneers/Sierra’s sole discretion. Sierra is not responsible for accidents, damages or stolen goods. ALL COUNTS ARE APPROXIMATE. Bidder should monitor their bids during the auction, if it is damaged or missing it is Sierra’s responsibility and bidder is to inform Sierra immediately upon discovery. Sierra urges all Bidders to remove all lots from the auction site as soon as possible and highly recommends removal occur no later than the close of business on the first available load-out day, with safety and security as the top considerations. ONCE AN ITEM IS REMOVED, ABSOLUTELY NO REFUNDS.

REMOVAL OF PURCHASED ITEMS: Sierra does not offer storage services. No item may be removed from the auction site until it is paid for in full, with partial payments considered additional non-refundable deposits towards the purchase. To avoid daily storage fees, all lots must be removed from Sierra’s facility by the date specified in the invoice email sent post-auction. IN CERTAIN SITUATIONS, Sierra, in its sole and exclusive judgment, may allow certain lots that Sierra deems difficult to move to be removed on date mutually agreed upon. A DAILY STORAGE PENALTY of $20.00/day shall be charged for all lots not removed by the specified removal date. Any item not removed within 72 hours following the removal date, or the mutually agreed upon date, will become the property of Sierra, WITHOUT EXCEPTION. Buyer is solely responsible for the safe removal of all their purchases. Sierra, at Buyer’s request, and in its sole discretion, may assist Buyer in the removal of its goods. Buyer may be charged Sierra’s current hourly rate per workman and forklift or other equipment utilized. In the event any work is requested after 3:00 PM, or on non-standard Sierra workdays, Sierra may charge Buyer 1.5 times it’s the standard hourly rate.

Disclaimer: Forklift assistance is provided as a COURTESY. By utilizing our assistance, the Buyer agrees to hold Sierra, including its employees, officers, and directors, harmless from any damage, injury, or liability that may arise during the removal of purchases, regardless of Sierra's involvement in the removal process. PLEASE NOTE that using a forklift to remove items may subject them to potential damage. Buyers may utilize their own transportation and rigging vendors. All lots and purchases must be removed in their entirety.

It is the customers responsibility to load out and remove all items from all Vehicle, Toys, Commercial Equipment, and other similar auction events. Sierra Auction does offer local delivery options at an additional price, please contact the vehicle manager for details and pricing.

Your shipper is responsible for the vehicle's condition after loading and removal from Sierra's lot. TRANSPORTERS MUST NOTIFY SIERRA MANAGEMENT OF ANY DEFECTS OR UNKNOWN DAMAGE PRIOR TO REMOVING VEHICLE. Please be sure to communicate with your shipping company to ensure a smooth transition.

INJURY: All persons arriving at Sierra’s locations for preview or load-out are notified that an auction site is a potentially hazardous place. Flammable, noxious, corrosive, pressurized substances, and other hazardous materials are present. Heavy equipment is being operated, and electric circuits may be live. Every person at the auction site before, during, and after the preview, sale and loadout shall be deemed to be there at their own risk with notice of the condition of the premises, the activities on the premises, and the conduct of third parties. All registered bidders shall so advise their guests, agents, and employees. NO PERSON(S) SHALL HAVE ANY CLAIM AGAINST SIERRA, ITS EMPLOYEES, AGENTS, AUCTIONEERS, CONTRACTORS, OFFICERS, OR PRINCIPALS FOR ANY INJURIES SUSTAINED, OR FOR DAMAGES TO OR LOSS OF PROPERTY OR PROFIT WHICH MAY OCCUR FROM ANY CAUSE WHATSOEVER.

PENDING SELLER CONFIRMATION AND UNRESERVED ITEMS: Sierra’s policy may allow our LICENSED consignors to determine if they wish to place a minimum reserve or “Seller’s Confirmation” on any lot. If a reserve amount is NOT MET through the NORMAL course of the auction, the Auctioneers/Sierra are given the authority to ADJUST the bid price on these assets and ask bidders to meet the minimum reserve. You and you alone as an auction participant determine what you are willing to pay for any asset. Please STOP bidding if you feel you have reached your maximum monetary comfort level. HOWEVER, Sierra reserves the ABSOLUTE right, at its sole and exclusive judgment, to withdraw any lot from auction, or add new lots at any time up to the item being declared sold.

3-DAY TEMPORARY VEHICLE TAGS: Temporary Vehicle Tags can be printed out from AZMVDNow's website at azmvdnow.gov/home. It is the BUYER’S RESPONSIBILITY to have temporary tags printed BEFORE arriving to the auction.

ARBITRATION: In the event a dispute shall arise between parties, it is hereby agreed that the dispute shall be referred to an accredited arbitration service at the sole discretion of SIERRA. All arbitration cases shall be in Phoenix, AZ, and held in accordance with the applicable “Rules of Arbitration”. The arbitrator’s decision shall be FINAL and legally binding and judgment may be entered thereon. Each party shall be responsible for its share of the arbitration fees in accordance with the applicable “Rules of Arbitration”. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator’s award, OR fails to comply with the arbitrator’s award, the other party is entitled to costs of suit, INCLUDING a reasonable attorney’s fee for having to compel arbitration, or for defence or enforcement of award.

All persons participating in a Sierra Auction Management, Inc. auction agree to the terms and conditions hereinafter, which shall form a binding contract between the participants and Sierra Auction Management, Inc. IF YOU DISAGREE WITH or DO NOT UNDERSTAND any of these terms, you are not permitted to bid in any Sierra Auction Management, Inc. auction event.

Buyer’s Premium: 17.00%

Sales Tax: 8.60% - Sales tax applied to bid amount plus Buyer’s Premium.

Credit Card Convenience Fee: A 3.00% Convenience Fee is applied to all Credit Card and Debit Card Payments.

Payment: Payments of any kind are NOT accepted at Sierra Auction facilities OR hosting properties. At the conclusion of the auction, winning bidders should receive an e-mailed invoice OTHERWISE invoices will appear under YOUR account page. NET PAYMENT DUE BY 3PM the Wednesday immediately after the auction. Accepted forms of payment include Visa, MasterCard, Discover, American Express, Bank Deposit, Wire Transfer, PayPal, and cash at bank. Payments of any kind are NOT accepted at Sierra Auction facilities OR hosting properties.

Sierra Auction does NOT accept personal or business checks. Cashier's checks AND cash can ONLY be deposited to a bank, currently Bank of America.

Credits On Account – Sierra provides refunds to buyers in the form of a credit when the amount is up to $50.00. Renege Fee: If buyer fails to fulfill their obligations for any of these terms and conditions in their entirety, the items on the bidder’s invoice MAY be considered abandoned and the bidder WILL be in breach of the purchase contract.

  1. The bidder’s credit card on file with Sierra Auction Management, Inc. WILL be charged the amount of the bidder’s invoice up to $200.00 plus an additional 3.00% inconvenience fee. If the bidder’s invoice is over $200.00, the bidder will be charged a 17.00% renege fee and a 3% inconvenience fee with a minimum of $206.00 ($200.00 + 3.00% inconvenience fee).
  2. In addition, the bidder’s ability to bid with Sierra Auction Management, Inc. MAY be revoked.
  3. ANY ACCOUNT THAT HAS BEEN BANNED IS UNDER MONITOR FOR REPLICATION OR RE-CREATION/SIMILAR ACCOUNTS AND/OR ANY PERSON/BUSSINESSES/ENTITIES FOUND TO BE CONNECTED TO BANNED ACOUNT MAY ALSO BE BANNED WITH/WITHOUT NOTICE PROVIDED.

Late Payment Fee: 3.00% of the remaining invoice balance amount per day after 3:00 pm on the Wednesday following the auction. Late payments WITHOUT the fee will ONLY be accepted if arrangements are made in advance with the MANAGER.

Any payments made after the deadline, without prior late payment arrangements, WILL be applied to the renege fee and ALL remaining amounts will be returned to the buyer.

Storage Fee:$10.00/day/lot until removed, beginning at 3:00 pm on Wednesday following the auction. Storage MUST be arranged with the surplus manager by 3:00pm Wednesday or 3 business days following the auction for any items left at any Sierra Auction facility OR hosting properties AND the storage fee MUST be paid in advance. Items remaining on site AFTER Wednesday WITHOUT a storage agreement will be considered ABANDONED and disposed of in a manor deemed fit by Sierra Auction Management, Inc. and NO Refund will be issued.

Merchandise becomes the full responsibility of the buyer at the TIME OF PAYMENT and the buyer assumes all risk of loss and damage to property at that time.

This is an Online Bidding Only auction, PLEASE DO NOT BID IF YOU ARE UNABLE TO PICK UP YOUR ITEMS WITHIN THE SCHEDULED REMOVAL DATES AND TIMES. No refunds or chargebacks will be granted due to lack of removal by the designated date. Items not removed by the designated removal date will be considered abandoned and disposed of by Sierra Auction Management, Inc.

Disclaimer: Forklift assistance is provided as a COURTESY. By utilizing our assistance, the Buyer agrees to hold Sierra, including its employees, officers, and directors, harmless from any damage, injury, or liability that may arise during the removal of purchases, regardless of Sierra's involvement in the removal process. PLEASE NOTE that using a forklift to remove items may subject them to potential damage. Buyers may also utilize their own transportation and rigging vendors. All lots and purchases must be removed in their entirety.

GENERAL TERMS AND CONDITIONS:

1. Per city code, if you are a City of Phoenix or a City of Tempe employee, you are not permitted to bid on any respective City of Phoenix or City of City of Tempe assets, either knowingly or unknowingly.

2. Sales Tax Exemption Qualifications: Sales Tax will be charged on all purchases, unless Sierra Auction Management, Inc. has on file or receives prior to the auction (1) Sales Tax Exemption Certificate acceptable to Sierra Auction Management, Inc. and to the State of Arizona, (2) COMPLETED Arizona Form 5000A, and (3) notarized Letter of Authorization, if you are not the company owner. You will not be granted tax exemption post-sale if these forms are not completed to the satisfaction of Sierra Auction Management, Inc. Customers/Bidders will ONLY be tax exempt for those assets which are LISTED on the 5000A Form. Out-of-state buyers are tax-exempt ONLY when Sierra Auction Management, Inc. has obtained their states’ Tax Exemption paperwork AND a completed AZ 5000A form.

3. Every asset is being sold “as-is,” including any and all defects, without expressed/implied warranties or guarantees. ALL SALES ARE FINAL. Sierra Auction Management, Inc. is not responsible for missing or broken items after the INVOICE has been paid. ABSOLUTELY NO REFUNDS*.

4. Sierra Auction Management, Inc., its owners, employees, and agents act merely as agents for Sellers/Consignors. Statements regarding the description and condition of assets may be made by the owners, employees and agents of Sierra Auction Management, Inc. including those made on its website, advertising, auction materials, and at the auction itself, are based on a rudimentary inspection. The bidder understands that statements by Sierra Auction Management, Inc. are not intended to be relied upon by the bidder, may contain errors, and the bidder agrees that he/she is not purchasing in reliance on those statements. For demonstration purposes, various pieces of equipment may be joined together. Do not assume a lot consists of more than one item simply because they are connected/photographed together. You are bidding on the item as it is described and not the entirety of all items that may appear in the photo. Sierra Auction Management, Inc. makes an effort to ensure the descriptions are accurate and the photos match as well. However, errors can occur in the listing and in that case, it will be the description and NOT the photo that will be the item won.

5. MOST assets are available for inspection prior to the auction, and it is the sole responsibility of the BIDDER to determine the condition of an asset prior to bidding/purchase. The bidder must understand what they are bidding on, how it is being sold, and all fees and taxes associated.

6. ADDITION TO OR WITHDRAWAL FROM AUCTION: The auctioneer and/or Sierra Auction Management, Inc. reserves the right to withdraw/add property listed/unlisted from the auction.

7. By placing a bid, the bidder is making an offer to purchase the asset at the bid price plus the additional fees, which if accepted, forms a binding contract to purchase the asset between Sierra Auction Management, Inc. and you the bidder. You the bidder understand that any such contract includes the terms in this Acknowledgement. Auctioneer and Sierra Auction Management, Inc. reserve the right to reject or void any Auction bid, whether winning or otherwise, that it believes, in its sole discretion, (i) has been made in bad faith, (ii) is intended to manipulate the Auction listing and sale process, (iii) violates any applicable law or regulation, or (iv) results from an online marketplace outage, failure, error, or delay.

8. Timed Auction and Staggered Closing. This auction will feature timed auction bidding and so bidders may want to set a Max Bid or watch the bidding from the auction page and NOT the watchlist window. If an asset receives a bid within the last minute the item MAY remain open an additional 2 minutes until no additional bids are received on that asset. EXAMPLE: Bidding will start to close at 5pm on Sunday with lot #1000. Bidding will close at 10 items per minute, until all items are closed.

9. PURCHASES MAY NOT BE REMOVED FROM THE PREMISES UNTIL PAYMENT IS RECEIVED IN FULL AND ALL REQUIRED DOCUMENTATION HAS BEEN PROPERLY COMPLETED. You, the bidder, understand and agree that purchased property will not be released from the premises until the funds are received and cleared by our banking institutions.

10. Purchasing individual whose name is on the invoice must pick up. If sending a representative to pick up for you, you MUST PROVIDE a signed Bidder Agreement, a copy of YOUR valid ID or Driver’s License, and the name of the person picking up to email cashiers@sierraauction.com.

11. All bidders must be 18 years of age or older and must possess a valid state issued ID/license.

12. INTERRUPTION OF SERVICE: Sierra Auction Management, Inc,. shall not be held responsible for any interruption in service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted, or error-free service or use of its website. Technology can and does fail. The bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. Sierra Auction Management, Inc., in its sole discretion, may void any sale, temporarily suspend bidding and re-list any items or lots that in Sierra Auction Management, Inc.’s discretion was affected by any malfunction. BIDDERS ARE REQUIRED TO BE ON THE MAIN PAGE OF THE AUCTION WEBSITE TO PLACE THEIR BIDS (THE AUCTION BLOCK). Please be advised that if you are viewing a vehicle lot description page, the auction timer displayed may not refresh in time. Consequently, any bids placed from these pages may not be successfully registered.

13. GOVERNING LAW; JURISDICTION: all matters arising out of or relating to these purchaser terms are governed by and construed in accordance with the internal laws of the state of Arizona without giving effect to any choice or conflict of law provision or rule (whether of the state of Arizona or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than those of the state of Arizona. Each party irrevocably and unconditionally agrees that it will not commence any action, litigation, or proceeding of any kind whatsoever against any other party in any way arising from or relating to these purchaser terms and all contemplated transactions in any forum other than the courts of the State of Arizona sitting in Maricopa County, Arizona. Each party irrevocably and unconditionally submits to the exclusive jurisdiction of such courts and agrees to bring any such action, litigation, or proceeding only in the courts of the State of Arizona sitting in Maricopa County, Arizona. EACH PARTY AGREES THAT A FINAL JUDGMENT IN ANY SUCH ACTION, LITIGATION, OR PROCEEDING IS CONCLUSIVE AND MAY BE ENFORCED IN OTHER JURISDICTIONS BY SUIT ON THE JUDGMENT OR IN ANY OTHER MANNER PROVIDED BY LAW.
